Policies
This Agreement is Made Between
Coach, Tara Pilaprat, FXYWLF Inc.
and
You, the Coachee/Client
COACHING SESSIONS
Coaching Sessions: Sessions are 60 minutes, and take place on the conference dial of the Coach’s choice (currently Zoom). There will be international numbers and/or the ability to join the call via internet dial for international clients and those desiring / preferring internet access.
Voxer supplemental support: May be offered as an additional service option or within long-term private coaching program for additional support as needed, to address Coachee questions. Coach will respond in a timely manner, generally within 48 hours. Weekends, holidays, vacation, and extenuating circumstances may occasionally delay responses. This support will take place in the Voxer app, unless an exception is made by the Coach.
Coaching packages, to include a mixture of sessions, types of coaching, and other benefits, will vary and are not based on a per-item cost. Client acknowledges that packages are value-based, and as such are not subject to product or single-service regulations.
Limits on coaching calls: Tara Pilaprat reserves the right to reschedule any coaching calls to accommodate holidays, health, travel and other needs as necessary, without limitation.
Cost of telephone calls: Unless otherwise agreed upon, You are responsible for initiating the call to any session, and You bear the cost of the telephone call. An audio Internet link is also available for clients who prefer this.
TERMS
This agreement, will begin upon acceptance, and will continue for as long as services are procured and desired by both parties. The requirement for the initial meeting is payment in full for the selected Coaching Program, and the fee for the Coaching Program is payable via the Shopping Cart at www.fxywlf.com.
The services to be provided by the coach to the client are coaching or tele-coaching, as designed jointly with the client. Coaching, which is not advice, therapy or counselling, may address specific personal projects, business successes, or general conditions in the client's life, relationships, or profession.
Upon completion of the initial Coaching Program, coaching will convert to a month-by-month basis, or the Coachee may choose to re-enlist in an additional Coaching Program.
Payment Plans
Payments are not refundable for any reason. All payments are required in advance of services rendered. All payments within packages are due regardless of whether or not You fully and faithfully participate. You acknowledge that Tara Pilaprat must receive my payment by the agreed upon date of each month or a $35 late fee will accrue every 30 days. If payment is not received within 30 days, You acknowledge that you may lose access to all downloadable materials without notice, will no longer receive coaching, and will still be accountable for making all payments through the end of this agreement. We may also terminate services if, in our sole opinion, You are conducting yourself or your business in a manner which is disparaging or disruptive to Tara Pilaprat or infringes upon FXYWLF or violates the confidentiality covenant stated above. In no event will any refunds will be issued.
Refunds
Refunds in full are permitted only before any services are provided. Once any portion of service, or services within a package of services, has been provided, no refunds will be permitted. Refunds are not permitted for missed or rescheduled sessions. Client is responsible for full payment of fees for the entire Program, regardless of whether Client faithfully completes the Program. If Client is unable to use the sessions for any reason, or fails to use sessions during designated timeframe, Client understands that fees are non-refundable.
If you are paying in monthly installments you hereby agree to remit the monthly payments via preauthorized automatic electronic debit to your banking account or credit card, which will be charged every month, and continuing for the duration of the program. Payments are not refundable for any reason. Payments are due regardless of whether or not you fully and faithfully participate, or whether you complete the full program.
Cost of telephone calls: Unless otherwise agreed upon, You agree that you are responsible for initiating the call to any session, and You bear the cost of the telephone call. An audio Internet link is also available for clients who prefer this.
Cancellations and No Shows
Client cancellation of and completion of scheduled appointments: Private Client programs and courses contain a predesignated and agreed upon number of sessions with Tara Pilaprat, which are included in the cost of your program. There is no penalty for sessions cancelled via email with 24 hour notice, or within reason during emergency situations. Tara Pilaprat, FXYWLF are under no obligation to refund or reschedule a coaching session if You fail to complete any or all of your private or group coaching sessions. In addition, all private coaching sessions included in the program must be used within 6 months of the date the program is purchased, or will be forfeited, unless an exception is made in writing from Tara Pilaprat, or unless otherwise noted in the details on a course or program web page.
Access to any digital delivered as part of the Client Program will begin once payments begin, and will be ended immediately and forfeited upon breach of the full contract.
CONFIDENTIALITY
The Coach promises the Client that all information provided to the coach will be kept strictly confidential. Any client stories which are shared on blog, video, tele course or other medium for marketing or coaching purposes, or within a program or course for sale, will be pursuant to client approval and/or will be made anonymous and fictionalized to protect the identity of the client. Coach has the right to use case studies or examples of Client’s situations and results or Client testimonials in future work but will never make reference to Client’s full identity, unless provided with written approval from the Client.
Coaching calls: The Coach reserves the right to record all sessions for review by a confidential certification committee for ongoing coach training and certification purposes only. No session will ever be made public.
I understand that all coaching sessions, both group or private, will be recorded via the Internet or telephone for my benefit, knowing that the use of technology is not always secure. I accept the risks of error, either technological or human, with regard to confidentiality of my information through the use of email, text, Facebook, posts at fxywlf.com, Zoom and other uses of technology either by me or to me. I understand and accept the risks related to sharing personal information with the other members of the program and other paying clients, and I will not hold Tara Pilaprat liable or responsible for any information shared by other members outside of this group. I understand that recordings of these calls will be shared with the other members, participants of the same program, and other paying clients. I understand that on occasion, recordings of both private and/or group sessions or classes may not be available due to technological or human error.
COACHING RELATIONSHIP
Throughout the working relationship, the Coach will engage in direct and personal conversations. The Client can count on the Coach to be honest and straightforward in asking questions and making requests. The Client understands that the power of the coaching relationship can be granted only by the Client, and the Client agrees to do just that: have the coaching relationship be powerful. If the Client believes the coaching is not working as desired, the Client will communicate that belief and take action to return the power to the coaching relationship.
RESALE OF SERVICE AND/OR INTELLECTUAL PROPERTY
No resale or distribution of services, products or intellectual property is permitted. Client agrees not to reproduce, duplicate, copy, sell, trade, resell, or exploit, for any commercial or personal purposes, any portion of the Service (including course materials & intellectual property), use of the Service, or access to the Service.
You acknowledge and understand that the methods, processes and strategies taught in sessions or programs with Tara Pilaprat, constitute our Proprietary System which is confidential, and for which we claim copyright protection. We have spent considerable time and efforts in developing this Proprietary System, which includes all materials associated with all courses, programs and mini-courses, all coaching strategies taught, and all associated coaching advice. You agree to maintain the absolute confidence of content and information provided by Tara Pilaprat, and our Proprietary System and agree not to duplicate, disseminate, distribute or otherwise disclose any part to any 3rd parties, for any reason. You further acknowledge that the Proprietary System and the Program(s) are and shall remain the property of Tara Pilaprat, and that you shall not infringe upon any part of the Proprietary System or content provided by Tara Pilaprat, nor claim any part as your property, nor attempt to replicate or copy any part for your own competitive benefit. You further agree that your violation of this provision will cause substantial harm to Tara Pilaprat, and for which we may seek all legal redress, which may include an injunction or substantial damages.
LIMITATION OF LIABILITY
While Tara Pilaprat is absolutely convinced that you will derive great benefits from this Coaching Program and that You should become as Magical as You envision, We of course cannot represent or guarantee that you will attain certain level of relationship, personal success or emotional wellness as a result of our Coaching Program. As with any coaching relationship, success is defined differently for each Individual, and each individual’s success depends on many factors, including your personal motivation, time commitment, how effectively you implement the strategies taught, and other factors. The cost of this Program is an “investment” in yourself, and, as with any investment, there is both great potential for a great return on your investment, and a risk there may be no return on this investment. You WILL learn a lot of usable and translatable life, relationship, spiritual and business strategies for success in these areas that, when followed by others and Tara Pilaprat herself, have achieved Life Changing results.
By using the Coach’s services, the Client accepts any and all risks, foreseeable or non foreseeable, arising from such transactions. All claims against the Coach must be lodged with the entity having jurisdiction within 100 days of the date of the first claim or otherwise be forfeited forever. Client agrees that the Coach will not be held liable for any damages of any kind, resulting or arising from, including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages happening from the use or misuse of the Service. Client agrees that use of this Service is at user's own risk.
DISCLAIMER
I understand that I am working with Tara Pilaprat for professional Love, Life, Success and Spiritual Coaching at the agreed fee. Professional coaching is distinctly different from counseling, psychotherapy or psychoanalysis and does not deal with the diagnosis or treatment of emotional problems. Since professional coaching does not constitute medical consultation or treatment, health insurance does not apply. These fees may be considered deductible business expenses.
DECLARATION
As Tara Pilaprat, a relationship, spirituality, life and success consultant, the Coach will be making suggestions, giving homework, advising, taking the Client through exercises and meditations, and teaching the Client the communication and personal techniques developed by both the Coach and by the Coach's Mentors. Unlike the co-active coaching aspects of working together, where the Coach may ask questions and walk alongside the Client on his/her journey, rather than tell him/her what the Coach believes is their best course of action, teaching and consulting does require the Coach to lead and guid the Client. It requires the Coach giving information and instruction to the Client. As an ordained (non-denominational) minister, the teaching and consulting from Tara Pilaprat, therefore, is to be considered pastoral advice. The decision to accept or decline information, instructions, guidance, suggestions, and teachings from the Coach is the Client's to make.
The Coaching Program is not intended to provide legal, financial or health-related advice. As the Client, I understand that services provided by Tara Pilaprat fall under the category of Life Coaching, and I further I understand that life coaching is a comprehensive process that may involve all areas of my life, including work, finances, health, relationships, education, sports and recreation. I acknowledge that deciding how to handle these issues and implement my choices is exclusively my responsibility.
As the Client, I understand and agree that I am fully responsible for my well-being during my coaching sessions, including my choices and decisions. I am aware that I can choose to disregard any advice given during public or private sessions, whether from and intuitive, coaching, health, or business standpoint. I recognize that coaching, mentoring, and intuitive guidance is not psychotherapy and that professional referrals will be given if needed.
As the Client, I understand that Tara Pilaprat does not treat mental disorders as defined in the DSM-V by the American Psychiatric Association. I understand that the advice and information given in the Program, whether written or spoken, is not a substitute for counseling, psychotherapy; psychoanalysis, mental health care or substance abuse treatment and I will not use it in place of any form of therapy. I agree that I am well adjusted, mentally health and ready to receive coaching and intuitive services. As the Client, I agree that if I am currently in therapy or otherwise under the care of a mental health professional, I have consulted with this person regarding the advisability of working with a life coach or spiritual teacher, or receiving intuitive advice, and that this person is aware of my decision to proceed with the life or spiritual coaching relationship.
By purchasing and entering into any coaching work with Tara Pilaprat, and by participation in and viewing of the content on www.fxywlf.com, the Client hereby agrees to this disclaimer.
